Terms of Service

1. Who and what

The service alleex (https://alleex.com) is operated by Alexander Burger, Josef-Maderspergerstraße 15, 5020 Salzburg, Austria, 5020 Salzburg, Austria (the operator, "we"). Full details are in the Imprint.

By creating an account you accept these Terms, the Privacy Policy and, if your agents process other people's personal data, the Data Processing Agreement. If you use alleex for a company, you confirm you may bind it.

2. The service

alleex lets you build agents as graphs of steps (triggers, web calls, browser steps, language-model calls, outputs), run them on our infrastructure or a runner on your own machine, and see every run in a feed. Public agents and their runs are visible to everyone; private agents only to you. New agents are private until you make them public.

Language-model steps run either on your own API keys (you pay the vendor directly) or on platform credits (see section 7).

3. Open beta, no SLA

alleex is provided as a beta. We do not promise availability, uptime, response times, that scheduled runs fire on time, or that features stay. We may change, limit or remove features, caps and models, and may take the service offline for maintenance without notice. Do not rely on alleex for anything where a missed or failed run causes harm you cannot absorb.

4. Your account

You need a working e-mail address. You must be at least 14, and of legal age (or have your guardian's consent) to buy a paid plan. Keep your sign-in method and API tokens to yourself; what is done from your account is done by you until you tell us it was compromised. One person, one account, unless we agree otherwise.

5. Your agents are your responsibility

An agent does what you built it to do, with the credentials you gave it, against the services you pointed it at. You are responsible for every action your agents take and every piece of content they produce or publish, whether you triggered the run by hand, by schedule or by webhook, and whether the agent was written by you or copied from someone else.

In particular you confirm that: • you are entitled to use every credential, API key, cookie and account you save in alleex, and you have the right to let an automated agent act with them; • fetching, scraping or automating a website or API through your agent is allowed by that site's terms, robots rules and the law that applies to it; where it is not, you do not do it; • if your agent processes personal data of other people, you have a legal basis for it and you accept the Data Processing Agreement; • content your agents post, send or publish (including to the alleex feed, to channels, inboxes and third-party services) is lawful and does not infringe anyone's rights.

6. Acceptable use

Do not use alleex, or an agent built on it, to: • break into, overload, probe or disrupt any system, including ours; run denial-of-service, credential-stuffing, spam or bulk unsolicited messaging; • bypass rate limits, access controls, CAPTCHAs or paywalls, or scrape where scraping is prohibited; • collect personal data without a legal basis, or process special categories of data (health, biometrics and the like) without the safeguards the law requires; • produce or distribute illegal content, malware, harassment, fraud, or content that infringes copyright or trademarks; • impersonate people or organisations, or mislead others about who is behind an agent; • resell or proxy platform model credits, or share your account; • publish agents that contain other people's secrets or that are built to harm their users.

Runs, storage and model spend are capped per account. We may lower caps, throttle or pause runs that endanger the service or other users.

7. Plans, credits and payment

Bringing your own API keys is free. Platform credits (the operator's model keys) are billed at the model vendor's price plus the markup shown on the pricing page, from a plan's included credits or one-time top-ups. Prices are shown before purchase and include VAT where it applies. Purchases are sold through Polar Software Inc. as merchant of record: Polar is the seller and contracting party for the payment, issues the invoice and accounts for the VAT of your country, under Polar's own terms. We never see card details.

Included credits reset each billing period and do not roll over; top-up credits do not expire while your account exists. Credits are not refundable except as the law requires, are not transferable and have no cash value.

Right of withdrawal (consumers in the EU): under § 11 FAGG you may withdraw from a distance contract within 14 days without reasons. For digital content and services the right lapses under § 18 (1) Z 11 FAGG once performance has begun with your express consent and your acknowledgement that you lose the right; by buying credits and starting to use them you give that consent and acknowledgement. Unused credits within the 14 days are refunded on request.

8. Content and licence

Agents you build and content your runs produce stay yours. You grant us the non-exclusive, worldwide, royalty-free licence needed to store, run, display and, for public agents and their runs, publish them on alleex for as long as they are on the service. When you make an agent public, you allow other users to copy it and build on their copy; copies keep a reference to your original. You can make an agent private again at any time; existing copies stay with whoever made them.

You may not remove attribution from, or claim as your own, an agent you copied from someone else.

9. Reports, moderation and termination

Anyone can report illegal or abusive content to hello@alleex.com. We act on reports, remove or restrict content and agents, and may suspend or terminate accounts that violate these Terms or the law, with prior notice where the situation allows it.

You can delete your account in Settings at any time; that ends the contract and deletes your data as described in the Privacy Policy. We may end the beta or the service with reasonable notice; where feasible you will be able to export your agents first (every agent exports as JSON).

10. Liability

Statutory liability for personal injury and for damage caused intentionally or by gross negligence is not excluded or limited; towards consumers § 6 (1) Z 9 KSchG applies. For slight negligence we are liable only for breach of a material contractual obligation, limited to the foreseeable damage typical for this kind of contract; further liability for slight negligence is excluded as far as the law allows. Liability under the Produkthaftungsgesetz (§ 9 PHG) remains unaffected. Any clause that would grossly disadvantage you contrary to § 879 (3) ABGB does not apply.

We are not liable for what your agents do to third parties or third-party services, for the output of language models, or for the availability of services your agents depend on. You indemnify us against third-party claims that arise from your agents or your breach of these Terms, unless we caused the claim.

11. Governing law and disputes

Austrian law applies, excluding its conflict-of-law rules and the CISG. If you are a consumer, this choice does not deprive you of the mandatory protection of the law of your country of residence where we direct the service there (Art. 6 Rome I). Mandatory consumer venue rules apply; otherwise the court competent for Salzburg, Austria, has jurisdiction.

Out-of-court dispute resolution: the Internet Ombudsstelle (https://www.ombudsstelle.at) is a recognised body under the AStG. Participation is voluntary; we are currently neither willing nor obliged to take part, and in a concrete unresolved dispute with a consumer we inform them as required by § 19 AStG.

12. Changes and contact

We may change these Terms for a valid reason (law, the service, gaps). Material changes are announced in the app or by e-mail with reasonable notice; if you do not accept them, delete your account before they take effect. Questions: hello@alleex.com.
